The land surveyor's role is first to clarify where the cadastral boundary is according to the records. The land surveyor must then assess and decide whether the boundary has moved as a result of a claim. The land surveyor's decision on a possible claim is final - which surprises many, as the land surveyor thus has a judge's role. However, the decision can be brought to court within 8 weeks if you disagree with it. The land surveyor also decides who will pay the costs of the boundary transaction, but this decision can be brought to the Fence Inspection for a decision.
The costs of a boundary transaction are in the vast majority of cases covered by the owner's legal expenses insurance, as long as a reasonable reason for carrying out a boundary transaction can be demonstrated.
