MARRIAGE COVENANTS

What is a prenuptial agreement?

A prenuptial agreement is a written agreement between spouses. The agreement stipulates that there shall be no community of property in the marriage, which spouses automatically enter into unless they agree otherwise.

Community property – also called joint ownership – means that you own all assets equally. After that, in the event of death, separation or divorce, all assets in the community property must be divided equally.

It is not only assets that the spouses owned at the time of marriage that are covered by community property. Everything that you as spouses acquire during the marriage will also be covered by community property, whether it is an inheritance, a gift, etc.

The purpose of the prenuptial agreement is to change this distribution and ensure that each of you can keep the assets covered by the prenuptial agreement, without any of them having to be divided upon death, separation or divorce.

It may be relevant to create a prenuptial agreement if one of you has a large debt. In that case, the one of you who does not have debt may risk having to hand over part of his or her assets to the other spouse's creditors in connection with his or her death. This may have the unfortunate consequence that the surviving spouse will not be able to afford to continue living in the family home.

In the event of divorce, it may also be the case that the wealthy spouse must pay the debts of the less wealthy spouse and thus risk coming out of the marriage with debts rather than assets.

Typically, a prenuptial agreement is created when one spouse owns an independent business, or if one wants to start a business that one wants to keep in the event of divorce, but a prenuptial agreement can be relevant in a wide range of cases.
