Claimed

The concept of claim dates back to ancient times and the rules in this area also date back to the Danish Law from 1683. So it is one of the oldest laws still in force in Denmark.

If someone has had goods and property in their hands and claimed it for twenty years unencumbered and unclaimed, they retain it without any other right to show, unrepentant and unclaimed, unless it is proven that they had it, either as a pledge or in a loan, or in defense.

This is what it says in Danish Law. Not exactly modern Danish. From the law, you can read that the following conditions must be met before you can win a claim.

Tolerance limit

The limit of tolerance in the law of neighbors is a broad concept that covers the fact that as an owner of a real estate property you do not have to put up with everything from your neighbors. The rules are based solely on case law, so there are no laws to rely on, but over the years the courts have taken a position on where the limit is in a wide range of cases, including:

  • Shade, leaf fall and other nuisance from the neighbor's trees
  • Reflection from black glazed bricks on the neighbor's roof
  • Viewing disturbance from construction on the neighboring property
  • High-voltage power lines, telephone mast or wind turbine close to the property
  • Noise and odor nuisance
