Ordinary money claim

Most debt collection cases concern completely ordinary monetary claims where a company has sold a product without receiving payment for it.

We constantly handle a large number of debt collection cases for large and small companies in the same situation, and we are also happy to help and advise you.

When you have determined that one of your customers has not paid their bill, a process is initiated that will ultimately force the customer to pay. Hopefully, the customer (debtor) will come to their senses and pay before it gets to that point.

 

The procedure is as follows:

  1. You or we send a reminder letter to the debtor, which complies with the rules of the Danish Collection Act. DKK 100 may be charged for each of the first three reminder letters, as long as at least 10 days elapse between the sending of each reminder letter.
  2. Once the 10-day deadline has expired, you hand over the case to us.
  3. We will then send a debt collection letter to the debtor demanding payment of your debt. The debt collection letter is accompanied by a debt collection fee. The debt collection fee depends on the amount owed.
  4. If the debtor objects to the claim, the objections will be forwarded to you for your comments. We will then provide you with an assessment and recommendation on how to proceed.
  5. If the debtor does not object or it is decided to maintain the claim, the next step is to send the case to court. This costs a court fee, which you must pay. The court fee for claims under DKK 50,000 is DKK 500, while for claims over DKK 50,000 it is DKK 750 + 0.5% of the claim.
  6. The court serves the payment demand/summons on the debtor, who then has 14 days to object to the court. If the debtor does not do so, you will receive a judgment against the debtor, which can be taken to the bailiff's court for the purpose of forcible collection of your receivable. If the debtor objects, the court will hear the case, after which a judgment will be issued. If the court fully or partially upholds the claim, the judgment can be used in the bailiff's court to forcibly collect your receivable.
  7. After a judgment has been obtained, the case will be forwarded to the bailiff's court, where we will appear on your behalf and question the debtor about his finances and ability to pay. We will take a lien (pledge) on the debtor's assets to the extent possible, to ensure that the debtor pays his debt to you. An installment plan will usually also be entered into with the debtor.
  8. We ensure that the debtor complies with the installment plan, and if necessary, we ensure that the debtor's assets are sold at a forced auction so that you can receive your receivables.
  9. As we receive money from the debtor, it will be forwarded to you. Your money is held in a specially secured client account, completely separate from the law firm's other accounts.
  10. When the debtor has paid all of his debt, including legal costs and interest, the case is closed.

If the debtor cannot be persuaded to voluntarily pay off the debt, a forced auction of the debtor's assets may be considered.

Rent collection

Rent collection is a special discipline within debt collection, as it is often not only about collecting your debt, but also about getting the tenant evicted from the lease.

When a tenant fails to pay rent, the landlord should send a demand as soon as possible with notice that the rental agreement will be terminated unless payment is made within the legal deadline.

We can help you formulate the demand correctly, and we can help you evict the tenant and collect your debt if the tenant still does not pay.

Rental legislation contains many requirements that must be met before a rental agreement can be terminated, including that the amount is calculated correctly, that notices are complied with, and that demand letters and termination letters are formulated correctly.

Therefore, if you owe money to a tenant, we recommend that you always contact us and let us represent your interests in connection with evicting the tenant.

Mortgage collection

Forced auction

If you have a claim against the debtor that has been established by judgment, or on a mortgage deed that the debtor has defaulted on, it is possible to have the debtor's assets seized and then sell them at a forced auction.

This may, for example, concern the debtor's house, car, smartphone or other assets of significant value.

Foreclosures of real estate are a special category that requires great expertise to handle. Every year, we conduct a large number of foreclosures of real estate on behalf of creditors or as an estate administrator.

Bankruptcy

If you owe money, it may be advantageous in certain cases to declare the debtor bankrupt. There are a number of conditions that must be met. We will assess for you whether it is possible to file for bankruptcy and whether it would be advantageous for you in the specific case.

Bankruptcy prevents the debtor from taking on new debt, and prevents the debtor from using money for other purposes, such as paying off other creditors before you. Certain payments made by the debtor in the period leading up to the bankruptcy can also be recovered from those who have received money from the debtor.

We will ensure that you file a bankruptcy petition with the bailiff's court and follow the case through to completion on your behalf.

International debt collection

If the case goes to court

If it becomes necessary to take the case to court to get the money back, we will first ask you if you are interested in this. In that case, you will be asked to pay the court fee and a small deposit to cover legal costs for conducting the case. You will therefore have to pay for our legal work in connection with the trial yourself, but in return, any legal costs that you may be awarded during the trial will be yours to pay.

If you have legal expenses insurance, we will apply for coverage of the legal costs from your insurance company. If the insurance covers it, you only have to pay the deductible on the insurance to conduct the case. If you do not already have legal expenses insurance, we recommend that you contact your insurance company immediately with a view to taking out one. The price is usually affordable and is quickly repaid if only one legal case is to be conducted.

If you choose to stop the case or withdraw it before the debtor has paid, you must pay the fee to which we would be entitled if the debtor had paid the full amount due.
