In a boundary dispute in January 2017, our client was successful in claiming 125 m2 of the landowners' association's common area adjacent to their summer house plot.
Our clients had purchased the house in 2014, but the previous owner had been using the disputed area since 1991 as if it were their own, and they had looked after and maintained it, mowed the grass and erected a wire fence around the area. The only access to the area was also through the summer house in question.
Since the owners had used the area intensively for a period of over 20 years, and since there was no agreement on the use with the landowners' association, the land surveyor concluded that our clients, as subsequent buyers, had gained title to the area.
