Lease Agreement – Not everyone can write a lease agreement

The headline may be a bit bombastic, but it is nevertheless true. In any case, not everyone should try to write a rental agreement. Because a lot can go wrong. And it can be a very long time before you discover the mistakes you may have made.

And do you think that you can just correct the mistake at that time and get the tenant to sign a new lease? Unfortunately, that won't work. Once the landlord and tenant have signed the lease, the landlord cannot subsequently require the tenant to sign a new contract, regardless of the reason for wanting the contract changed.

If you have the courage (and the means) to write your own rental contract, here are a few headings for what you need to have in mind before you get started.

  • Are you writing the lease from scratch or using a template?
  • Should the rental agreement be time-limited?
  • What should the rent be, what does it include, and according to what rules should the rent be determined?
  • How are electricity, water, heating and internet consumption settled?
  • Who should maintain what?
  • Who is your new tenant? Is they creditworthy, or will they soon move out without paying?
  • Are tenants allowed to have pets?
  • And much more
