It has recently become very popular to rent out (parts of) your home via the website Airbnb. This can be the entire home, or one or more rooms.
However, renting out via Airbnb in Denmark is not entirely problem-free.
If you own a single-family home that you want to rent out in whole or in part, there are probably no obstacles to doing so.
If you want to rent out all or part of your apartment, you are basically free to do so. However, many homeowners' associations have in their statutes limited the owners' right to rent out their apartments, so you need to make sure that it is allowed in your homeowners' association, or you may need to obtain permission from the homeowners' association board before you start renting out.
If you own a cooperative housing, the same rules apply as for owner-occupied apartments. It is generally permitted to sublet the cooperative housing partially, but most cooperative housing associations have restrictions on the right of cooperative members to sublet. You should therefore review the articles of association and, if necessary, obtain permission from the board of directors before you start renting out.
If you live in a private rental home, it is far from certain that you will be allowed to sublet the rental property in whole or in part. You will always have the right to sublet a single room, but the landlord has the right to be informed of who you are renting to and to receive a copy of the rental agreement. You should therefore make an agreement with your landlord before you start renting. If you sublet without the landlord's permission, you risk the landlord terminating the rental agreement.
For public rental housing, the same rules apply as for private rental housing, however, the rent for subletting may not exceed your own rent. You must therefore have an agreement in place with the housing association before you start subletting.
If you imagine that you pay 4,800 DKK per month for a 2-room apartment, and you want to rent out one room via Airbnb, then in public rental housing you can charge a maximum of 80 DKK per night in rent for the room (4,800 divided by 2 divided by 30).
